Michael Crispin v Barton Malow Builders, LLC and Saylor\u2019s Inc<\/em><\/strong>, No 363928, Court of Appeals of Michigan, April 11, 2024.<\/p>\n A Michigan appellate court has allowed a negligence lawsuit to proceed against a pair of subcontractors, ruling that workers compensation exclusive remedy doesn\u2019t apply when a worker who becomes injured on a jointly controlled job site seeks to sue a company other than his employer. Defendant acquiesced to this decision rather than appealing it onto the Michigan Supreme Court and eventually settled the matter with Mr. Crispin.<\/em><\/p>\n Ramon Razo v GM & Sons<\/strong>, <\/em>2025 ACO #9, State of Michigan, Workers\u2019 Disability Compensation Appeals Commission.<\/p>\n Razo was a seasonal construction worker that proved that he was entitled to wage loss benefits even during the \u201coff-season\u201d. Here the Appeals Commission affirmed that a\u00a0partially disabled employee who makes a good-faith job search, as we find plaintiff established he did do, after incurring a work-related injury and disability, is eligible to receive the rate of weekly wage-loss benefits that the employee is entitled to receive under subsection (7) as if totally disabled.<\/em><\/p>\n Note this case was initially tried on January 22nd<\/sup>, 2018, and went through several appeals until this final decision rendered in August 2025.<\/em><\/p>\n Latham v Barton Malow Co<\/em><\/strong>, 2006 WL 2956334 (Mich App Oct 17, 2006) and<\/p>\n Latham v Barton Malow Co<\/em><\/strong>, 480 Mich 105, 746 NW2d 868 (2008)<\/p>\n A general contractor can be held liable for an injury to a subcontractor’s employee when it is shown that the general contractor failed to ensure compliance with safety procedures\/protection and the contractor ignored the non-use of provided safety equipment by a number of workers on its construction site. In our case, we successfully argued that the employee of a subcontractor who fell 13 – 17′ while unloading drywall from a lift was entitled to sue the general contractor even though the worker was not wearing mandated safety harness.<\/em><\/p>\n Andrew Lefko<\/strong><\/em>: Public Act 103, known as “Andy’s Law<\/strong><\/em>” went into effect Oct. 1, 2001. The law creates penalties of up to one year in prison for injuring and up to 15 years in prison for killing a highway construction or maintenance worker. It also imposes a maximum penalty of $7,500. Buehner, III <\/a>, Aiello Law Group, PLLC<\/a>.<\/span><\/p>\n Having carefully reviewed the 1,955-page administrative record (hereinafter “AR”), as well as the parties’ lengthy briefs, the Court finds and concludes that plaintiff is entitled to LTD benefits under the policy and that defendant’s termination of those benefits was contrary to the policy.<\/p>\n Under the policy, plaintiff is entitled to LTD benefits if, due to sickness or injury, she is under the regular care of a physician and is “unable to perform the duties of any gainful occupation for which [she is] reasonably fitted by education, training or experience”2<\/sup> (AR at 121).
