It\u2019s also alarming to realize that some of these people are not even actual<a href=\"https:\/\/www.aiellolawgroup.com\/are-you-an-independent-contractor.html\"> independent contractors<\/a>, and that their employers unlawfully manipulated their employment status in in hopes of preventing them from ever collecting the <a href=\"https:\/\/www.aiellolawgroup.com\/practice-areas\/workers-compensation\">workers compensation<\/a> benefits they might one day need \u2013 after all, all it takes is a few signatures and <a href=\"https:\/\/www.aiellolawgroup.com\/practice-areas\/workers-compensation\">compensation<\/a> through IRS 1099 forms.<\/p>\n<p>Fortunately, there is still good news for Michigan workers. Michigan law utilizes the \u201c20 Common Law Factors\u201d of \u201cRev. Rul. 87-41, 1987-1 CB 296\u201d to determine and define the relationship between employees and employers, which means how you are classified by your employer legally has no impact on whether or not you receive <a href=\"https:\/\/www.aiellolawgroup.com\/practice-areas\/workers-compensation\">workers compensation<\/a> benefits if you are involved in a work-related accident. In fact, in accordance with the 20 Common Law Factors, you are <strong><u>not<\/u><\/strong> considered an independent contractor if:<\/p>\n<ul>\n<li>You are required to obey another person\u2019s instructions about \u201cwhen, where, and how\u201d you perform your responsibilities;<\/li>\n<li>You have been formally trained in some manner on how to accomplish your tasks in a specific way;<\/li>\n<li>Your performance or contribution directly impacts the success or continuation of the company or business you are working for;<\/li>\n<li>Your \u201cservices must be rendered personally;\u201d<\/li>\n<li>You do <strong>not<\/strong> hire, supervise, or pay assistants;<\/li>\n<li>You are in a longstanding or \u201ccontinuing relationship\u201d with the company or business you are servicing;<\/li>\n<li>You must complete a set number of hours per week;<\/li>\n<li>You are require to work full time;<\/li>\n<li>You work \u201con the premises of the person or person for whom the services are performed;\u201d<\/li>\n<li>You are required to \u201cperform services in the order or sequence set by the person or persons for whom the services are performed;\u201d<\/li>\n<li>You are required to submit oral or written reports;<\/li>\n<li>You have a strict payment schedule in which you are paid by the hour, week, or month;<\/li>\n<li>Your business or traveling expenses are paid for by the person you are providing services to;<\/li>\n<li>You were given or provided with tools, equipment, or other materials by the person you are working for;<\/li>\n<li>You do not have, nor have you ever invested in, any kind of designated facilities to perform your services in (you rely on an employer for a workspace);<\/li>\n<li>You cannot \u201crealize a profit or suffer a loss\u201d as a result of your services;<\/li>\n<li>You work exclusively for one person or organization (you still may be classified as an employee if you have multiple, unrelated jobs);<\/li>\n<li>You do not make your services available to the general public;<\/li>\n<li>You are vulnerable to being terminated at will;<\/li>\n<li>You are free to leave or quit your job, or cease providing services, at any time without risks of liability.<\/li>\n<\/ul>\n<p>If you are struggling to receive the <a href=\"https:\/\/www.aiellolawgroup.com\/practice-areas\/workers-compensation\">workers compensation<\/a> benefits you need all because you were told by your employer that you are an <a href=\"https:\/\/www.aiellolawgroup.com\/are-you-an-independent-contractor.html\">independent contractor<\/a>, let one of our reputable <a href=\"https:\/\/www.aiellolawgroup.com\/practice-areas\/workers-compensation\">workers compensation attorneys<\/a> at <a href=\"https:\/\/www.aiellolawgroup.com\">Aiello Law Group<\/a> have a good look at your case.
